EPICISE 300 CLUB – TERMS OF SERVICE

Please read these Terms of Service (“Terms”) carefully before using the Epicise 300 Club service (“Service”). By subscribing to or using the Service, you agree to be bound by these Terms.
1. SERVICE DESCRIPTION
1.1 What We Provide
Epicise 300 Club is a fitness tracking and motivation service that includes:
- Activity tracking and goal-setting tools
- Curated music shuffle features synchronized with your walking activities
- Educational content about fitness, wellness, and personal finance
- Travel destination discovery features
- Progress tracking and achievement monitoring
1.2 What We Do NOT Provide
Epicise does not provide financial services, banking services, investment advice, or money management services. We do not hold, manage, invest, or control any funds on your behalf. Any recommendations regarding personal savings strategies are educational only and not personalized financial advice.
2. SUBSCRIPTION AND PRICING
2.1 Subscription Fee
The base monthly subscription fee is $24.95 per month (“Base Fee”), billed automatically on a recurring monthly basis.
2.2 Performance-Based Discounts
You may earn daily discounts by achieving your personalized daily activity goals:
- Each day you meet your activity goal: 2% discount ($0.50) applied to that month’s subscription
- Maximum potential monthly discount: $15.00 (30 days × $0.50)
- Minimum monthly charge after discounts: $9.95
2.3 Discount Calculation
- Discounts are calculated based on verified activity data tracked through the Service during each calendar month
- Discounts apply only to the subscription fee for the month in which they are earned
- Discounts cannot be carried forward, transferred, or redeemed for cash
- Your monthly charge will reflect: Base Fee ($24.95) minus earned discounts for that month
2.4 Billing
- You will be charged monthly on the same day you initially subscribed
- The charge amount will reflect your earned discounts for the completed billing period
- Payment is due immediately upon billing
- Accepted payment methods: [credit card, debit card, etc.]
2.5 Payment Authorization
By providing payment information, you authorize Epicise to charge the applicable monthly subscription fee (as adjusted for any earned discounts) to your chosen payment method. This authorization remains in effect until you cancel your subscription.
3. SUBSCRIPTION TERM AND RENEWAL
3.1 Automatic Renewal
YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW EACH MONTH UNTIL YOU CANCEL. You will be charged the applicable monthly fee (Base Fee minus any earned discounts) unless you cancel before your next billing date.
3.2 Free Trial (if applicable)
If you enrolled through a free trial promotion:
- The trial period lasts [X days] from enrollment
- You will not be charged during the trial period
- At the end of the trial, your subscription automatically converts to a paid monthly subscription at the Base Fee ($24.95/month, subject to performance-based discounts)
- You may cancel anytime during the trial period without charge
- You must cancel at least 24 hours before the trial ends to avoid being charged
3.3 Renewal Reminder
We will send you an email reminder at least 7 days before your subscription renews with:
- The upcoming renewal date
- The amount you will be charged (reflecting any earned discounts from the prior period)
- Instructions for how to cancel
4. CANCELLATION AND REFUNDS
4.1 How to Cancel
You may cancel your subscription at any time by:
- Logging into your account at [website] and clicking “Cancel Subscription” in Settings
- Emailing support@epicise300club.com with “Cancel Subscription” in the subject line
- Calling [phone number] during business hours
Cancellation is simple and takes less than 2 minutes. We do not require you to speak with customer service or provide a reason for cancellation.
4.2 When Cancellation Takes Effect
- Cancellation takes effect at the end of your current billing period
- You will retain access to the Service through the end of the paid period
- You will not be charged for subsequent months after cancellation
- You will receive email confirmation of your cancellation within 24 hours
4.3 No Refunds
Monthly subscription fees are non-refundable. When you cancel, you will not receive a refund for the current billing period, but you will not be charged for future periods.
Exception: If we terminate your account for reasons other than violation of these Terms, we will provide a pro-rated refund for the unused portion of your current billing period.
4.4 Reactivation
You may reactivate a cancelled subscription at any time. Reactivation is treated as a new subscription beginning on the date you reactivate, and prior progress or discounts do not carry over.
5. ACTIVITY TRACKING AND GOAL ACHIEVEMENT
5.1 Goal Setting
- Upon enrollment, you will set a personalized daily activity goal based on your fitness level
- You may adjust your goal at any time through your account settings
- Goals must be within reasonable ranges established by the Service
5.2 Activity Verification
- Activity is tracked through [connected fitness devices, smartphone sensors, manual entry, etc.]
- You are responsible for ensuring accurate data synchronization
- Epicise reserves the right to verify activity data and disqualify achievements that appear fraudulent or manipulated
- We may use reasonable technological and manual review processes to detect anomalies
5.3 Discount Eligibility
- Discounts are earned only for verified activity on days when your subscription is active
- Technical issues, device malfunctions, or failure to sync data may prevent discount qualification
- Epicise is not responsible for lost discounts due to third-party device or connectivity issues
- Disputed activity achievements must be reported within 7 days of the date in question
5.4 No Guarantee of Discounts
Achievement of activity goals and earning of discounts depends entirely on your individual effort and performance. Epicise makes no guarantee that you will earn any specific discount amount.
6. VACATION SAVINGS RECOMMENDATIONS
6.1 Educational Content Only
The Service includes educational recommendations and tools to help you save money for travel or other personal goals. These recommendations are:
- General educational content, not personalized financial advice
- Suggestions only—you have complete discretion over your personal finances
- Not monitored, managed, or verified by Epicise
6.2 We Do Not Manage Your Money
Epicise does not:
- Open, manage, or have access to any savings account on your behalf
- Hold, invest, or control any funds for you
- Provide banking, investment, or financial management services
- Guarantee any specific savings amount or investment return
- Act as a financial advisor, fiduciary, or registered investment advisor
6.3 Your Responsibility
Any decision to open a savings account, transfer funds, or save money toward a vacation is entirely your personal financial decision. You are solely responsible for:
- Choosing where and how to save money
- Managing your personal finances
- Understanding the terms and fees of any financial accounts you open
- Tax implications of your savings and investment decisions
6.4 Savings Tracker Tool
The Service may include a voluntary savings tracking tool that allows you to:
- Set personal savings goals
- Track progress toward those goals
- Receive reminders to transfer money to your personal savings
This tracker is for your personal convenience only. The data you enter is self-reported and not verified by Epicise. The tracker does not connect to any actual financial accounts and has no impact on your subscription or discounts.
6.5 Third-Party Financial Institutions
If we provide links or information about banks, credit unions, or other financial institutions, we do so for informational purposes only. We do not endorse any specific institution and receive no compensation for these references. Always review the terms and conditions of any financial institution before opening an account.
7. INTELLECTUAL PROPERTY
7.1 Our Content
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, music curation algorithms, and software, are owned by Epicise or our licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
7.3 Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the Service
- Reverse engineer or attempt to extract source code from the Service
- Remove or alter any copyright, trademark, or other proprietary notices
- Use the Service for any commercial purpose without our written permission
7.4 User Content
If you submit content to the Service (photos, comments, feedback, etc.):
- You retain ownership of your content
- You grant Epicise a worldwide, royalty-free license to use, display, and distribute your content in connection with the Service
- You represent that you own or have permission to share any content you submit
- You are responsible for ensuring your content does not violate any laws or third-party rights
8. PRIVACY AND DATA
8.1 Privacy Policy

8.2 Health and Activity Data

You are responsible for:

- All activity that occurs under your account
- Notifying us immediately of any unauthorized access

You agree to provide accurate, current, and complete information during registration and to update it as necessary.

You may not:
- Share your account with others
- Create multiple accounts to gain unfair advantages
- Manipulate activity data or use automated tools to fake activity
- Use the Service for any illegal purpose
- Harass, abuse, or harm others through the Service
- Transmit viruses, malware, or other harmful code
- Attempt to gain unauthorized access to the Service or other users’ accounts
9.4 Account Termination
We reserve the right to suspend or terminate your account if:

- You engage in fraudulent activity
- You manipulate activity tracking to earn undeserved discounts
- We are required to do so by law
- We discontinue the Service
10. DISCLAIMERS AND LIMITATIONS OF LIABILITY

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10.2 No Medical Advice
Epicise is not a medical service. The Service does not provide medical advice, diagnosis, or treatment. Before beginning any fitness program:
- Consult with a qualified healthcare provider
- Disclose any medical conditions or physical limitations
- Stop activity if you experience pain, dizziness, or other concerning symptoms
You use the Service at your own risk. Epicise is not responsible for any injuries, health conditions, or medical issues that may result from using the Service.
10.3 Third-Party Services
The Service may integrate with third-party fitness devices, music services, and other platforms. We are not responsible for:
- The accuracy or reliability of third-party data
- Changes to third-party services that affect the Service
- Privacy practices of third-party providers
- Technical issues with third-party integrations
10.4 No Financial Guarantees
We make no guarantees regarding:
- The amount of discounts you will earn
- Your ability to achieve fitness goals
- The amount you will save for vacation or other purposes
- The suitability of any savings strategies for your situation
10.5 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPICISE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Personal injury or property damage
- Any damages arising from your use or inability to use the Service
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO EPICISE IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Epicise and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any content you submit to the Service
- Any misrepresentation you make regarding your health, fitness level, or activity data
12. DISPUTE RESOLUTION
12.1 Governing Law

12.2 Arbitration Agreement

13.3 Continued Use Means Acceptance
Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modifications, you must cancel your subscription.
14. GENERAL PROVISIONS
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Epicise regarding the Service and supersede any prior agreements.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
14.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any affiliate or successor without restriction.
14.5 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Epicise.
14.6 Force Majeure
Epicise is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, labor disputes, or internet failures.
14.7 Survival
Provisions that by their nature should survive termination (including payment obligations, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive termination of these Terms.

IMPORTANT CONSUMER NOTICES:
AUTOMATIC RENEWAL: Your subscription continues indefinitely and will automatically renew each month at the applicable rate (base fee minus any earned discounts) until you cancel. You may cancel at any time by logging into your account or contacting customer support. Cancellation takes effect at the end of your current billing period.
NO REFUNDS: Subscription fees are non-refundable. If you cancel, you will not be charged for future months, but you will not receive a refund for the current month.
CANCELLATION: You may cancel your subscription at any time through your online account dashboard by clicking “Cancel Subscription” in Settings. The cancellation process is simple and takes less than 2 minutes. You are not required to speak with customer service to cancel.
