FitEppy Terms of Service (TOS)

1. Overview

FitEppy (“we,” “us,” or “our”) is an interactive fitness and entertainment platform where your real-world activity powers story-based adventures, challenges, and RPG-style experiences. By accessing or using our website, mobile app, or related services (collectively, “the Platform”), you agree to these Terms of Service. If you do not agree, you should not use FitEppy.

2. Eligibility & Accounts

You must be at least 16 years old to use FitEppy. By creating an account, you agree to provide accurate and complete information and to keep your login credentials secure.
You may log in through email registration or by using Google Sign-In, which provides secure authentication through Google’s API.

3. Fitness and Health Disclaimer

FitEppy does not provide medical, fitness, or nutritional advice. Our services are educational and behavioral in nature. You are responsible for your own fitness decisions, and you should consult your physician before beginning any new exercise program.
We provide general calculators (X10, BMR, and TDEE) to help you estimate energy use, but these are tools—not prescriptions or recommendations.

4. Billing, Tokens, and Refunds

  • Subscriptions are billed manually each term. We do not auto-rebill.

  • If you stop participating, we assume you have discontinued use, and billing ceases automatically.

  • Tokens are digital access credits representing a revocable license to specific services or game features—not a purchase of digital property.

  • Tokens expire five (5) years after purchase, or sooner if required by law.

  • Refunds for unused tokens may be requested at any time and will be pro-rated less applicable payment processing fees.

  • Tokens may be used to unlock episodes, challenges, or in-app tools such as avatar upgrades or body measurement features.

  • FitEppy reserves the right to modify token values or mechanics at any time for fairness, compliance, or operational reasons.

5. Producer Program

Approved Producers can publish fitness-powered series or challenges on the Platform.
Revenue from token redemptions is divided 75% to the Producer and 25% to FitEppy, after processing fees.
Producers are responsible for ensuring that their content complies with all applicable laws and does not make unverified health or medical claims.

6. User Conduct

You agree not to misuse the Platform or interfere with other users’ experiences. This includes attempting to manipulate data, impersonate others, or exploit gameplay or reward systems.
Abuse of the Platform may result in account suspension or termination.

7. Data Collection and Use

FitEppy collects limited personal information, including your name, email, billing address, and—optionally—current and target weight.
We also collect usage data from your device, such as GPS, accelerometer, and cookie-based session information, to track workouts and gameplay progress.

8. Limitation of Liability

FitEppy and its affiliates are not liable for injuries, losses, or damages arising from your participation in fitness activities or use of the Platform. You acknowledge that all physical activity carries inherent risk and agree to assume full responsibility for your own safety.

9. Intellectual Property

All videos, stories, designs, graphics, and in-app assets are owned by FitEppy or licensed Producers. You may not reproduce, distribute, or modify Platform content without written consent.

10. Termination

We may suspend or terminate access for violations of these Terms. You may cancel your account at any time by contacting support@fiteppy.com.

11. Changes to Terms

We may update these Terms occasionally. Continued use of the Platform after updates indicates your acceptance of any changes.
